Depending on the technology and applicable law, these services may use cookies, pixels, tags, or similar technologies to understand website activity, measure advertising, create audiences, or deliver advertisements.

Some state privacy laws provide qualifying consumers with rights to opt out of certain uses of personal data for targeted advertising or sale/sharing. Connecticut, for example, requires covered controllers to honor applicable opt-out rights for targeted advertising and sales, while California requires applicable businesses to provide opt-out mechanisms where personal information is sold or shared as defined by its law.

If Cheer Gym Advantage engages in practices subject to these requirements, appropriate opt-out mechanisms should be made available.

  • Sale of the business
  • Bankruptcy

12. WE DO NOT INTEND TO SELL CUSTOMER LISTS

Cheer Gym Advantage does not intend to operate as a data broker or make its business model the sale of customer contact lists.

However, some privacy laws define terms such as “sale” or “sharing” more broadly than an ordinary cash transaction, particularly in connection with advertising technologies.

Accordingly, whether a particular advertising or analytics relationship constitutes a regulated sale or sharing must be evaluated based on the technologies actually used.

13. DATA RETENTION

We retain personal information for as long as reasonably necessary for purposes such as:

  • Providing services
  • Maintaining accounts
  • Fulfilling contractual obligations
  • Processing transactions
  • Maintaining financial records

The FTC recommends that businesses evaluate the information they maintain and take appropriate steps to protect customer data against security threats.

However:

NO INTERNET TRANSMISSION OR ELECTRONIC STORAGE SYSTEM CAN BE GUARANTEED TO BE 100% SECURE.

If you opt into marketing text messages, you may be able to opt out by following the instructions provided in those messages, such as replying STOP, depending on the service used.

Before launching SMS marketing, have the actual consent language and workflow reviewed for applicable telecommunications and marketing requirements.

17. CHILDREN'S PRIVACY

Cheer Gym Advantage is a business resource and educational platform for adults operating youth-sports businesses.

Our website, courses, memberships, and business resources are not directed to children under 13.

We do not knowingly seek to collect personal information directly from children under 13 through our business platform.

The FTC's Children's Online Privacy Protection Rule imposes requirements on covered websites and online services directed to children under 13 or knowingly collecting their personal information.

If you believe a child has provided personal information directly to Cheer Gym Advantage through our platform, contact us at:

[email protected]

so we can evaluate the matter and take appropriate action.

18. INFORMATION ABOUT ATHLETES ENTERED BY GYM OWNERS

Cheer Gym Advantage resources may contain templates that gym owners use independently to manage their own businesses.

Unless our specific service expressly provides a hosted athlete-management feature, customers should not submit sensitive athlete records, injury files, abuse reports, medical information, or other highly sensitive information to Cheer Gym Advantage simply because one of our downloadable templates contains fields for that information.

Downloaded forms are generally intended to be used by the customer within the customer's own systems.

The gym owner remains responsible for the privacy and security of information the gym collects using those materials.

19. THIRD-PARTY LINKS

Our website may link to third-party websites, services, applications, organizations, or resources.

Their privacy practices are controlled by their own policies.

Cheer Gym Advantage is not responsible for the privacy practices, content, security, or practices of third-party websites or services.

Users should review applicable third-party policies before providing personal information.

20. YOUR PRIVACY RIGHTS

Depending on where you live and whether a particular privacy law applies to Cheer Gym Advantage, you may have rights relating to your personal information.

These may include the right to request:

  • Confirmation of whether personal information is processed
  • Access to certain personal information
  • Correction
  • Deletion
  • A portable copy of certain information
  • Information about categories of data collected
  • Information about certain disclosures
  • Opt-out from certain targeted advertising
  • Opt-out from certain sales or sharing
  • Limitations involving certain sensitive information
  • Appeal of certain denied requests
  • Freedom from unlawful discrimination for exercising privacy rights

California and Connecticut are examples of states that provide qualifying consumers with several such privacy rights, although coverage and requirements depend on the business and circumstances.

21. HOW TO SUBMIT A PRIVACY REQUEST

To submit a privacy request, contact:

Email: [email protected]

Please include sufficient information to help us identify your account and understand your request.

We may need to verify your identity before completing certain requests.

We will respond as required by applicable law.

22. AUTHORIZED AGENTS

Where applicable law allows an authorized agent to submit a privacy request on your behalf, we may request documentation demonstrating that the agent has authority to act for you and may separately verify your identity.

23. NON-DISCRIMINATION

Where required by law, we will not unlawfully discriminate against you for exercising applicable privacy rights.

24. DO NOT SELL OR SHARE / TARGETED ADVERTISING

If Cheer Gym Advantage becomes subject to laws requiring a mechanism to opt out of certain sales, sharing, or targeted advertising, we will provide the applicable control.

Potential link:

DO NOT SELL OR SHARE MY PERSONAL INFORMATION

and/or:

YOUR PRIVACY CHOICES

should be implemented if legally required based on our actual business practices.

California specifically requires covered businesses that sell or share personal information to provide appropriate opt-out functionality.

25. GLOBAL PRIVACY CONTROL AND OPT-OUT PREFERENCE SIGNALS

Some jurisdictions require certain covered businesses to recognize qualifying browser-based universal opt-out mechanisms or preference signals.

Connecticut, for example, requires covered controllers to honor applicable opt-out preference signals for certain targeted advertising or sales.

If these requirements apply to Cheer Gym Advantage, our website configuration will be designed accordingly.

26. USERS OUTSIDE THE UNITED STATES

Cheer Gym Advantage is currently intended primarily for users located in the United States unless otherwise stated.

If we intentionally market to or serve users in jurisdictions such as the European Economic Area, United Kingdom, Canada, or other regions with separate privacy requirements, additional disclosures, consent mechanisms, data-processing terms, and rights procedures may be required.

This Privacy Policy should therefore be reviewed before actively expanding internationally.

We may update this Privacy Policy periodically to reflect:

  • Changes to our services
  • Changes to technology
  • Changes to our vendors
  • Changes to our data practices
  • Changes in applicable laws
  • Business changes

The revised policy will display an updated Last Updated date.

Where required by law, additional notice or consent may be provided for material changes.
